As <a href=\"https:\/\/www.healthcare.gov\/quick-guide\/dates-and-deadlines\/\" rel=\"noopener noreferrer\" target=\"_blank\">open enrollment<\/a> for private health insurance purchased through the Affordable Care Act\u2019s (ACA) government-operated marketplaces began on November 1, 2025, millions of households will no longer be able to afford health insurance.<\/p>\n<p>In response to the Covid-19 pandemic, the 2021 <a href=\"https:\/\/www.kff.org\/health-reform\/issue-brief\/impact-of-key-provisions-of-the-american-rescue-plan-act-of-2021-covid-19-relief-on-marketplace-premiums\/\" rel=\"noopener noreferrer\" target=\"_blank\">American Rescue Plan Act<\/a> dramatically reduced the cost of private health insurance for low- and middle-income earners by enhancing public subsidies for plans purchased through <a href=\"https:\/\/www.commonwealthfund.org\/publications\/maps-and-interactives\/aca-state-marketplace-models-and-key-policy-decisions\" rel=\"noopener noreferrer\" target=\"_blank\">ACA marketplaces<\/a>. When the One Big Beautiful Bill Act (OBBBA) <a href=\"https:\/\/www.hrw.org\/news\/2025\/07\/01\/us-budget-would-benefit-wealthiest-at-expense-of-rights\" rel=\"noopener noreferrer\" target=\"_blank\">became law<\/a> in July 2025, it expanded and made permanent numerous tax cuts that <a href=\"https:\/\/www.jct.gov\/publications\/2025\/jcx-37-25\/\" rel=\"noopener noreferrer\" target=\"_blank\">disproportionately benefit<\/a> wealthy households and large corporations, while failing to extend these enhanced subsidies. Without new legislation, the subsidies will expire at the end of 2025.<\/p>\n<p>\u201cCongress\u2019 failure to extend these subsidies is driving the government shutdown and will harm millions of people already struggling with soaring prices and healthcare costs,\u201d said <a href=\"https:\/\/www.hrw.org\/about\/people\/matt-mcconnell\" rel=\"noopener noreferrer\" target=\"_blank\">Matt McConnell<\/a>, economic justice and rights researcher at Human Rights Watch. \u201cThese cuts are making ordinary people sacrifice their health to pay for tax breaks for the wealthy few.\u201d<\/p>\n<p>The introduction of the ACA in 2010 made health care <a href=\"https:\/\/www.kff.org\/affordable-care-act\/health-policy-101-the-affordable-care-act\/\" rel=\"noopener noreferrer\" target=\"_blank\">more accessible<\/a> for millions of people, including by reshaping federal regulation of the private health insurance industry, which in 2023 <a href=\"https:\/\/www.census.gov\/library\/publications\/2024\/demo\/p60-284.html\" rel=\"noopener noreferrer\" target=\"_blank\">provided health insurance coverage<\/a> for more than 90 percent of the population, or over 300 million people. Among other changes, the law created <a href=\"https:\/\/www.kff.org\/understanding-health-insurance-marketplaces\/\" rel=\"noopener noreferrer\" target=\"_blank\">government-operated marketplaces<\/a> through which people who do not receive health insurance from their employers or public programs could purchase coverage from a private company.<\/p>\n<p>The ACA also established <a href=\"https:\/\/www.irs.gov\/affordable-care-act\/individuals-and-families\/the-premium-tax-credit-the-basics\" rel=\"noopener noreferrer\" target=\"_blank\">public subsidies<\/a> to reduce the cost of health insurance premiums for these private marketplace plans. But <a href=\"https:\/\/www.kff.org\/quick-take\/a-steep-subsidy-cliff-looms-for-older-middle-income-enrollees-if-aca-enhanced-tax-credits-expire\/\" rel=\"noopener noreferrer\" target=\"_blank\">those earning<\/a> above 400 percent of the <a href=\"https:\/\/www.healthcare.gov\/glossary\/federal-poverty-level-fpl\/\" rel=\"noopener noreferrer\" target=\"_blank\">federal poverty level<\/a>\u2014$62,600 for an individual in 2025\u2014were ineligible. This so-called subsidy cliff was especially harmful to older people who were not or were not yet eligible for <a href=\"https:\/\/www.kff.org\/medicare\/health-policy-101-medicare\/?entry=table-of-contents-who-is-covered-by-medicare\" rel=\"noopener noreferrer\" target=\"_blank\">Medicare coverage<\/a>, the public health insurance program for older people and people with disabilities, because health insurance companies <a href=\"https:\/\/www.kff.org\/faqs\/faqs-health-insurance-marketplace-and-the-aca\/marketplace-health-plans-and-premiums\/can-be-charged-more-because-of-my-age\/\" rel=\"noopener noreferrer\" target=\"_blank\">were allowed<\/a>, within certain limits, to charge older people more for the same services.<\/p>\n<p>The 2021 <a href=\"https:\/\/www.kff.org\/health-reform\/issue-brief\/impact-of-key-provisions-of-the-american-rescue-plan-act-of-2021-covid-19-relief-on-marketplace-premiums\/\" rel=\"noopener noreferrer\" target=\"_blank\">American Rescue Plan Act<\/a> temporarily addressed this subsidy cliff by expanding eligibility to those earning above this income limit and <a href=\"https:\/\/www.kff.org\/quick-take\/what-an-income-cap-could-mean-for-aca-enrollees-and-the-federal-budget\/\" rel=\"noopener noreferrer\" target=\"_blank\">capping premium costs<\/a> for standard marketplace plans under the ACA at 8.5 percent of household income. These \u201c<a href=\"https:\/\/www.congress.gov\/crs-product\/R48290\" rel=\"noopener noreferrer\" target=\"_blank\">enhanced premium tax credits<\/a>,\u201d originally set to expire at the end of 2022, were extended through 2025 by the <a href=\"https:\/\/www.hrw.org\/news\/2022\/08\/16\/us-major-steps-address-health-care-climate-crisis\" rel=\"noopener noreferrer\" target=\"_blank\">Inflation Reduction Act<\/a>.<\/p>\n<p>Since coming into effect, these changes have <a href=\"https:\/\/www.hrw.org\/news\/2022\/06\/06\/expiring-assistance-threatens-affordable-health-care-us\" rel=\"noopener noreferrer\" target=\"_blank\">significantly reduced<\/a> healthcare costs for millions of people. The population covered by ACA marketplace plans has <a href=\"https:\/\/www.kff.org\/affordable-care-act\/state-indicator\/marketplace-enrollment\/?activeTab=graph%C2%A4tTimeframe=0&amp;startTimeframe=5&amp;selectedRows=%7B%22wrapups%22:%7B%22united-states%22:%7B%7D%7D%7D&amp;sortModel=%7B%22colId%22:%22Location%22,%22sort%22:%22asc%22%7D\" rel=\"noopener noreferrer\" target=\"_blank\">more than doubled<\/a>, rising from 11.4 million in 2020 to 24.3 million in 2025, <a href=\"https:\/\/www.kff.org\/affordable-care-act\/enrollment-growth-in-the-aca-marketplaces\/\" rel=\"noopener noreferrer\" target=\"_blank\">helping drive<\/a> a decline in the country\u2019s uninsured rate.<\/p>\n<p>\u201cInstead of ensuring ordinary people can access adequate health care, the administration and Congress have chosen to prioritize large tax handouts for the wealthy and well-connected,\u201d said <a href=\"https:\/\/www.oxfamamerica.org\/explore\/people\/rebecca-riddell\/\" rel=\"noopener noreferrer\" target=\"_blank\">Rebecca Riddell<\/a>, senior policy lead for economic justice at Oxfam America. \u201cNot extending subsidies risks further inflaming economic inequality, which is already sky high and likely to increase following massively regressive cuts to social protection passed in July.\u201d<\/p>\n<p>On July 4, 2025, the OBBBA <a href=\"https:\/\/www.hrw.org\/news\/2025\/07\/01\/us-budget-would-benefit-wealthiest-at-expense-of-rights\" rel=\"noopener noreferrer\" target=\"_blank\">became law<\/a>, expanding and making permanent many tax cuts <a href=\"https:\/\/taxpolicycenter.org\/briefing-book\/how-did-tax-cuts-and-jobs-act-change-personal-taxes\" rel=\"noopener noreferrer\" target=\"_blank\">originally implemented<\/a> during President Donald Trump\u2019s first term that <a href=\"https:\/\/www.jct.gov\/publications\/2025\/jcx-37-25\/\" rel=\"noopener noreferrer\" target=\"_blank\">disproportionately benefit<\/a> large corporations and the country\u2019s wealthiest households. The tax breaks for just the <a href=\"https:\/\/www.americanprogress.org\/article\/1-trillion-in-medicaid-cuts-1-trillion-in-tax-giveaways-for-the-richest-1-percent-the-one-big-beautiful-bills-budget-math\/\" rel=\"noopener noreferrer\" target=\"_blank\">richest 0.1 percent of households<\/a> alone cost <a href=\"https:\/\/www.cbo.gov\/publication\/61734\" rel=\"noopener noreferrer\" target=\"_blank\">substantially more per year<\/a> than the enhanced premium tax credits; around $50 billion compared to $35 billion.<\/p>\n<p>To partly offset the reduction in revenue from these tax cuts, the act <a href=\"https:\/\/www.hrw.org\/news\/2025\/07\/01\/us-budget-would-benefit-wealthiest-at-expense-of-rights\" rel=\"noopener noreferrer\" target=\"_blank\">dramatically reduces<\/a> federal funding for public programs essential for human rights, <a href=\"https:\/\/www.cbpp.org\/research\/health\/by-the-numbers-harmful-republican-megabill-will-take-health-coverage-away-from\" rel=\"noopener noreferrer\" target=\"_blank\">including a projected<\/a> $1 trillion in cuts over the coming decade to Medicaid, the public health insurance program for people with low-incomes, which will disproportionately hurt Black people and other people of color.<\/p>\n<p>Unless Congress extends these enhanced subsidies, millions of people will soon be forced to choose between paying for extremely expensive health insurance or risking the potentially catastrophic harm of being uninsured, Human Rights Watch and Oxfam America said.<\/p>\n<p>Premium costs for the average subsidized ACA marketplace plan will more than double, rising from an average of $888 per year in 2025 to $1,904 in 2026, <a href=\"https:\/\/www.kff.org\/affordable-care-act\/aca-marketplace-premium-payments-would-more-than-double-on-average-next-year-if-enhanced-premium-tax-credits-expire\/\" rel=\"noopener noreferrer\" target=\"_blank\">according to KFF<\/a>, a nonprofit health policy research organization. KFF <a href=\"https:\/\/www.kff.org\/affordable-care-act\/aca-marketplace-premium-payments-would-more-than-double-on-average-next-year-if-enhanced-premium-tax-credits-expire\/\" rel=\"noopener noreferrer\" target=\"_blank\">estimated<\/a> that the annual cost for an average 60-year-old couple earning just above the ACA\u2019s income eligibility limit\u2014or $85,000 annual household income in 2026\u2014will increase by more than $22,600 next year, rising from 8.5 percent of household income to about 25 percent.<\/p>\n<p>The Commonwealth Fund and Urban Institute, two US-based nonprofit organizations, have estimated that <a href=\"https:\/\/www.urban.org\/sites\/default\/files\/2025-09\/4.8-Million-People-Will-Lose-Coverage-in-2026-If-Enhanced-Premium-Tax-Credits-Expire.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">about 4.8 million people<\/a> will become uninsured next year if these subsidies expire, increasing the US\u2019 uninsured population by about 21 percent.<\/p>\n<p>People without health insurance are far more likely to <a href=\"https:\/\/www.hrw.org\/report\/2022\/04\/12\/if-im-out-insulin-im-going-die\/united-states-lack-regulation-fuels-crisis\" rel=\"noopener noreferrer\" target=\"_blank\">forgo and ration<\/a> health care because of costs and are much <a href=\"https:\/\/d197nivf0nbma8.cloudfront.net\/uploads\/2025\/06\/LDI-Yale-Letter-Final.pdf\" rel=\"noopener noreferrer\" target=\"_blank\">more likely to die<\/a> as a result. Cost-based access barriers are incompatible with health care as a human right for all, worsen inequalities, and can undermine people\u2019s ability to bear costs associated with the enjoyment of other human rights such as the rights to housing, food, and education.<\/p>\n<p>Older people <a href=\"https:\/\/www.kff.org\/medicare\/health-policy-101-medicare\/?entry=table-of-contents-who-is-covered-by-medicare\" rel=\"noopener noreferrer\" target=\"_blank\">without Medicare coverage<\/a> because they are not yet old enough to qualify for coverage, or because of their immigration status or other restrictions, will be especially harmed. The country\u2019s large and growing population of part-time and gig workers, also <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2021\/12\/15\/racial-and-ethnic-differences-stand-out-in-the-u-s-gig-workforce\/\" rel=\"noopener noreferrer\" target=\"_blank\">largely people of color<\/a>, who are <a href=\"https:\/\/www.hrw.org\/news\/2025\/05\/22\/medicaid-waste-stems-boardrooms-not-basements\" rel=\"noopener noreferrer\" target=\"_blank\">not legally required<\/a> to receive <a href=\"https:\/\/www.kff.org\/health-costs\/health-policy-101-employer-sponsored-health-insurance\/\" rel=\"noopener noreferrer\" target=\"_blank\">employer-sponsored health insurance<\/a> under the ACA, will also be <a href=\"https:\/\/www.cbpp.org\/blog\/ask-an-expert-enhanced-premium-tax-credit-ptc-expiration\" rel=\"noopener noreferrer\" target=\"_blank\">disproportionately impacted<\/a>. Even those with health insurance <a href=\"https:\/\/familiesusa.org\/resources\/if-millions-lose-health-insurance-well-all-pay-for-it-in-our-premiums\/#:~:text=Employers%20and%20insured%20Americans%20should%20worry%20about,be%20called%20a%20%E2%80%9Chidden%20health%20care%20tax.%E2%80%9D\" rel=\"noopener noreferrer\" target=\"_blank\">are likely to see<\/a> their premium costs increase next year because of cost-shifting associated with this dramatic increase in the uninsured population.<\/p>\n<p>On October 1, the federal government <a href=\"https:\/\/www.npr.org\/2025\/10\/15\/nx-s1-5575134\/government-shutdown\" rel=\"noopener noreferrer\" target=\"_blank\">shut down<\/a> as a result of Congress\u2019 inability to pass a budget for the 2026 fiscal year. Democratic Party lawmakers, the minority party in both chambers of Congress, have said that their support for any bill to reopen the government is <a href=\"https:\/\/www.cbsnews.com\/news\/government-shutdown-affordable-care-act-enhanced-premium-tax-credit\/\" rel=\"noopener noreferrer\" target=\"_blank\">contingent on<\/a> the extension of these enhanced healthcare subsidies.<\/p>\n<p>Under international law, everyone has the human right to the highest attainable standard of physical and mental health, which includes the right to access healthcare goods and services regardless of one\u2019s ability to pay.
