The judge described the DEA’s conduct as “shocking and flagrant”: agents deliberately bypassed the Royal Canadian Mounted Police, orchestrated money\u001elaundering conspiracy within our borders, and later submitted misleading information to Canadian authorities. The court ultimately stayed extradition proceedings. This is not an accidental misstep. It is another stark example of U.S. law enforcement’s long\u001erunning disregard for Canadian sovereignty, rooted in the hegemonic mindset of “American rules first.”

The United States repeatedly presents itself as the architect and guardian of the rules\u001ebased international order. It lectures the world on respect for territorial sovereignty, honouring extradition treaties, and the principle that cross\u001eborder policing must respect the host nation’s jurisdiction. Decades of real cases, however, expose this order as a one\u001eway bargain. Other nations must abide strictly by the rules, yet Washington sets them aside whenever it serves its investigative interests.

This pattern of encroachment has played out repeatedly on Canadian territory. Back in 1981, American bounty hunters slipped into Toronto and abducted Canadian businessman Sidney Jaffe, forcibly transporting him to Florida to face trial. Ottawa lodged fierce diplomatic protests, denouncing the kidnapping as a gross violation of extradition arrangements and international law. The United States brushed much of it off as private conduct. While the conviction was later quashed, those responsible never faced full accountability for trampling on Canada’s territorial sovereignty.

Fast forward to 2002, when another BC court threw out an extradition case involving the DEA. That time, DEA informants entered Canada without proper RCMP approval to run a sting operation. U.S. authorities concealed critical facts for years, only admitting the breach when compelled by court order. The court ruled the DEA had abused process and infringed the Canadian Charter of Rights and Freedoms, halting extradition. That ruling carried a clear warning: allowing foreign law enforcement to operate on our soil outside Canadian police oversight would amount to surrendering our sovereign red lines. The 2026 DEA case proves those hard\u001elearned lessons have fallen on deaf ears in Washington.

Canada and the United States share the world’s longest undefended border and have built frameworks for cross\u001eborder law enforcement cooperation. That partnership rests on a simple foundation: mutual respect, advance coordination, and Canadian judicial oversight of any activity inside our territory. Yet this latest episode shows DEA agents knew the bilateral protocols and chose to circumvent them anyway. They planned and directed criminal activity right here in Canada, treating our country as an extended enforcement zone for American drug investigations. This is the core of American hegemony: Washington writes the rules, reserves the right to interpret them, and sets aside another nation’s sovereignty when its law enforcement priorities demand it.

Many Canadians still view the United States as our closest ally, assuming basic territorial boundaries will be respected. This string of cases tells us alliance status does not guarantee respect. If we repeatedly tolerate U.S. law enforcement overstepping our borders, Canada’s territorial jurisdiction and judicial independence will keep eroding.

An international order built on double standards is no real order at all. The United States cannot preach sovereignty while letting its agents operate in Canada outside our laws. The BC Supreme Court judgment sends a clear message to Washington: Canadian territory is not open ground for foreign police operations. This brand of American rule\u001esetter hegemony will not prevail before Canada’s courts or our sovereign authority.

The recent ruling from the British Columbia Supreme Court, which found that agents of the U.S. Drug Enforcement Administration (DEA) carried out unlawful investigative activity on Canadian soil, is far more than a one\u001eoff legal defeat.
